Gates arrest
was improper
says FOX News analyst
Excerpt:
Judge Andrew Napolitano, a Fox News judicial
analyst, explained that under Massachusetts law,
Cambridge Sergeant Jim Crowley did act improperly
by arresting historian Henry Louis Gates.
His argument essentially boils down to the difference
between public and private domain. As Crowley arrested
Gates for causing a “public disturbance,” the
action is improper on its face due to the fact that Gates was in his
own home. Additionally, Napolitano said, it
was illegal for the police to enter the house to begin with,
as the source of the report did not pass legal
muster to constitute probable cause.
Napolitano added that because of the violation
of Gates’s constitutional rights,
he would be eligible to pursue legal action against
the police department
I'm no lawyer, but I disagree with that part in bold.
If the cops get a good-faith call that two men are forcing open a neighbor's
front door what
are they supposed to do? Get a lawn chair and wait for the two
men to come outside again?
What if two men are seen forcing their way into a sorority house?
It's my understanding the cops knocked and asked if they could come
in - am I wrong?

Racism is
a two-way street

arrested in their homes every day. It's usually the

of the world, watch a few episodes of "COPS."

Alas, the average professor can be awfully hard
to bring down off his high horse. Gates was just back
from a trip to China, so he probably hadn't heard
a story that moved on the wires that morning about
five Jersey City cops gunned down by a perp who'd
hidden a shotgun under his bathrobe. One died,
along with the shooter and his girlfriend.
Chances are that Sgt. Crowley, who answered a
possible burglary-in-progress call at Gates' home
knew about it. Cops notice stories like that.
They're a reminder that even small, seemingly inoffensive
fellows can shoot you graveyard dead.
My good friend Gene must not have heard about what happend to Marc Perkel.
Perkel was drinking a beer one Saturday night while watching TV inside
his home.
The Springfield Missouri cops knocked on his door and asked him to
please step outside.
Perkel did as he was asked and the cops busted him for Public Intoxication.
That's some cold shit. That's why Perkel moved to California -
to get away from
vengeful, small-town crooked police who had his name on their minds.
What's next?
He gets pulled over and the cops drop an ounce of cocaine in
his back seat?
But I agree with Gene's larger point:
It's wrong for us to side with Gates just because he's Black
just like it's wrong
for the Rethugs and Talk Radio whores to side with the cops just
because Gates is Black.
Remember when they tried to arrest David Koresh?
The GOP called the FBI "bullies" and
G. Gordon Liddy suggested you "aim for their heads"
because they wear bullet-proof vests and a normal chest hit would not
kill them.
Funny how shit changes, depending on who's president.

Seems to me if you're a "real" comedian (not Randi Rhodes, for example)

ought to be allowed to do the kind of comedy you want. If enough people

repulsed then the market will put you out of business and solve the
problem.

Obama Turned Black

He's in hot water now. For a moment, on national
television, the President of the United States turned black!
Last week, when his buddy "Skip" Gates got busted
for being Black in Boston, Barack Obama forgot his official role:
to soothe America's conscience with the happy
fairy tale that his election marked the end of racism in the USA.
Instead, Obama, the excruciatingly middle-of-the-road
President, was seized by Barack the militant State Senator
from the South Side of Chicago, who reminded
us that cops bust Black guys for no goddamn good reason all the goddamn
time...
Yes, I joined the Hope Parade and voted for Obama,
expecting just this one change: a direct attack on the remaining areas
of official sanction of racist policies and practices.
I'm still waiting. It was quite inspiring, last Thursday, to the see a
Black man
appear, if momentarily, behind the Presidential
seal. Unfortunately, Obama's swift demand for equal justice under the law
was
provoked only when the whip came down on someone,
like himself, whose professional and class status had, they presumed,
made them exempt from the daily insults and assaults
visited on their less privileged brothers.
Apparently that "Beer summit..." didn't go as
planned and I have a theory:
Thru inexperience or downright "Let's
fuck him," the cops screwed Obama over.
I give you my Nancy Grace Guarantee
that BEFORE this get-together was announced they had
the cop's word that he was going to be nice and
shake hands and agree and admit that "both
sides
made mistake they regret" and
"they're all happy to have this behind him."
Without that up-front agreement it's big-time danger to give Crowley the spotlight.
This is why Obama and Hillary argued last summer
about ground rules for meeting with the enemy.
If you don't get their word up-front about what's
to be agreed on, the Cambridge cop is free to say,
"They ganged up on me and demanded an apology
but I said No because *I* did nothing wrong."
While they were meeting, Wolf the Whore read a statement from the Black
cop on the scene who basically said:
"Don't let them railroad you and be sure they
know the extent of the damage their fake charges caused."
Sounds like after Crowley gave them his word he'd be nice, he changed
his mind or his fellow cops
changed his mind for him because the whole meeting idea turned out
to be a near disaster.
This "Teaching moment" had to be hidden in the dark so nobody could
see it.

With the Democrats in the Senate dropping the

it's clear that Democrats are afraid of the Republicans.
The are compromising trying
to get Republican votes that they don't need
and votes they aren't really going to get.
No Republican is going to vote to reform health care no matter how much the Democrats cave in.
The Democrats have the votes and they should just
pretend the Republicans don't exists
and do the right thing. But it looks like 1994
all over again where the Dems caved in and
it cost them the election. I was hoping they
learned something but apparently they haven't.
They are afraid of a party that has no power.
Perhaps it's time for Obama to show some
leadership and get the Democrats in line.
